Summary

The court held that the lease was ambiguous as to whether rent had to be paid in cash, but upheld the trial court's interpretation that cash was required. It also upheld the finding that the defendant breached the lease by failing to tender rent after the lease provision governing substantial reductions in water consumption was triggered. The court nevertheless reversed because the defendant was entitled to equitable nonforfeiture relief and could retain possession upon payment of the rent arrearage, interest, and costs determined on remand.
