Supreme Court of Colorado

The People of the State of Colorado v. Isaac U. Mion

January 26, 20262026 CO 5

Summary

The court held that, when a defendant claims that a consumed product contained multiple intoxicants, “substance” under the involuntary-intoxication statute means the entire product rather than each individual intoxicant. Because Mion knowingly smoked the joint and should have known that it was intoxicating, his intoxication was self-induced and he was not entitled to the defense instruction. The court therefore reversed the court of appeals’ judgment and remanded for further proceedings.
