Supreme Court of Colorado
The People of the State of Colorado v. Michelle Re Nae Bialas.
June 23, 20252025 CO 45
Summary
The court held that free, contemporaneous virtual access alone does not satisfy a criminal defendant's Sixth Amendment right to a public trial. Excluding all spectators, including the defendant's family, from the physical courtroom for the remainder of trial was a nontrivial closure that failed each applicable requirement for a constitutional courtroom closure. The court therefore affirmed the court of appeals' judgment reversing the conviction and remanding for a new trial.
