Supreme Court of Colorado

In re the Parental Responsibilities Concerning Children: K.M.S., M.D.S., and R.E.S., and Concerning Suzanne Nicolas…

June 9, 20252025 CO 35

Summary

The court held that the parents of a deceased biological parent lack standing to seek grandparent visitation after the child has been adopted by new parents. It construed the statutory definition of grandparent in the present tense and concluded that adoption terminates the former parental relationship on which grandparent status depends. The court therefore reversed the court of appeals and remanded for further proceedings.
