Summary

The court held that an adult offender’s life-without-parole sentence for felony murder is not categorically unconstitutional under the Eighth Amendment or the Colorado Constitution. It also held that Sellers’s sentence was not grossly disproportionate because his participation in an aggravated robbery that resulted in a death made the offense grave and serious, notwithstanding the later statutory reclassification of felony murder. The court therefore affirmed the judgment below, partly on different grounds.
