Supreme Court of Colorado

Colorado Cab Company, LLC, a Colorado limited liability company d/b/a Denver Yellow Cab. Judgment Reversed en banc…

November 14, 2023538 P.3d 328

Summary

The court held that proximate cause in a rescuer case turns on whether the rescuer’s injuries were reasonably foreseeable in light of the defendant’s tortious conduct and the nature of the rescue attempt. Because reasonable jurors could find that the assailant’s theft and use of the cab as a weapon were a foreseeable escalation of the assault, the court held that proximate cause was not determinable as a matter of law and reinstated the jury’s verdict.
