Supreme Court of Colorado
20SC343- People v. Vialpando
June 21, 2022512 P.3d 106
Summary
The court held that the prosecutor’s references to Vialpando’s continuing flight during trial did not improperly penalize her exercise of the right to a jury trial, particularly because the comments were tied to evidence of actual flight and to the vehicular-eluding charge. The court also held that the remaining errors, viewed cumulatively, did not deprive Vialpando of a fair trial. It therefore reversed the court of appeals’ judgment and remanded for consideration of the remaining issues.
