Summary
The court reversed the trial court’s order suppressing drugs, paraphernalia, and statements obtained after officers searched Peluso’s residence without a warrant. It held that, although Peluso’s girlfriend did not actually reside there at the time, the officers reasonably believed she had common authority based on her updated address, possession of a key, relationship with Peluso, and conduct at the scene. The court also concluded that Peluso’s lack of an opportunity to object did not invalidate the search because it had already commenced before officers contacted him.
