Supreme Court of Colorado

The People of the State of Colorado v. Clarence Mosely

June 7, 2021488 P.3d 1074

Summary

The court held that a jury need not unanimously agree on the particular reason self-defense was disproved, so long as it unanimously agrees that the prosecution disproved self-defense beyond a reasonable doubt. Because self-defense functions as an additional element of the charged offense, unanimity is required as to the ultimate determination, not the alternative means used to reach it. The court therefore reversed the court of appeals and remanded for reinstatement of Mosely's felony-menacing conviction.
