The court held that the general prohibition on imposing imprisonment for one offense and probation for another in a multi-count case does not apply when the probation sentence is SOISP imposed under SOLSA, even if the underlying offense is a sex-related offense subject to a determinate sentence. Because Rainey's consecutive prison and SOISP sentences were therefore legal, the district court erred in ordering resentencing. The court made the rule to show cause absolute and remanded for further proceedings consistent with its opinion.
