Summary
The court held that the prohibition on imposing prison for one offense and probation for another in a multi-count case does not apply when the probation sentence is imposed under the Sex Offender Lifetime Supervision Act and requires sex-offender intensive supervision, even if the offense is sex-related rather than technically a sex offense. Because Coleman's consecutive prison and determinate SOISP sentences were authorized, the district court erred in declaring them illegal. The court made its rule to show cause absolute and remanded for further proceedings consistent with its opinion.
