Summary
The court held that the statutory prohibition on combining a prison sentence with probation in a multicount case does not apply when the probationary sentence is Sex Offender Intensive Supervision Probation imposed under the Sex Offender Lifetime Supervision Act. Because Lowe's consecutive prison and SOISP sentences were lawful, the district court erred by vacating his guilty pleas, sentences, and judgment of conviction. The court remanded for reinstatement of those matters and resolution of any outstanding postconviction motions.
