Summary

The court held that a defendant need not have an express supervisory duty to occupy a position of trust with respect to a child. Special access arising from an existing relationship or surrounding circumstances may establish an implied duty or responsibility for the child's welfare or supervision during that access. Applying that rule, the court concluded that sufficient evidence supported Manjarrez's conviction and affirmed the court of appeals.
