Summary

The court held that the plea-agreement proviso in section 18-1-409(1) bars appellate review of the intrinsic propriety of an agreed-upon sentence, but does not bar a nonconstitutional challenge to the manner in which the sentence was imposed. Because Sullivan challenged the sentencing court's reliance on an incorrect statutory range, his appeal was not barred even though his total sentence fell within the agreed range. The court reversed the dismissal and remanded for consideration of the merits.
