Summary

The court held that the competency-motion statute imposes threshold requirements that counsel must satisfy before the statutory competency-determination procedures are triggered. Although courts must not second-guess an adequate motion supported by specific facts, they may reject an inadequate proffer, and the trial court did not abuse its discretion in doing so here. The court therefore reversed the court of appeals and directed reinstatement of Lindsey’s convictions.
