Supreme Court of Colorado

v. Espinoza

May 26, 2020463 P.3d 855

Summary

The court held that Espinoza's ten attempted first-degree-murder convictions, each involving a different victim, were not supported by identical evidence even though they arose from one fire-setting act. Because the convictions were separate crimes of violence arising from the same incident, the sentencing statute required consecutive sentences. The court therefore reversed the court of appeals' judgment and reinstated the requirement of consecutive sentencing.
