The court held that after an administrative law judge determines that an employer has overcome a Division Independent Medical Examination doctor's opinion that a claimant has not reached maximum medical improvement, the ALJ may determine the claimant's MMI status as a factual matter. The ALJ may also determine the claimant's permanent impairment rating after considering the medical evidence. The court therefore reversed the court of appeals and remanded for further proceedings.
