The court held that an attorney did not violate Colorado Rule of Professional Conduct 8.4(d) merely by failing to pay a court-reporting firm when he had no legal obligation to make the payment. It also held that the relevant Chief Justice Directive did not govern the dispute and, in any event, did not make the attorney personally responsible for the expense. The court reversed the Rule 8.4(d) determination and remanded for reconsideration of the sanction because the extent to which that determination affected the nine-month suspension was unclear.
