Supreme Court of Colorado

in Interest of J.D

June 8, 20202020 CO 48

Summary

The court held that a juvenile magistrate may reconsider or modify rulings in a delinquency case before the proceedings culminate in a final order or judgment. Because J.D. had not been sentenced and his deferred adjudication was not final, the magistrate had jurisdiction to consider his motion under Crim. P. 32(d) to withdraw his guilty plea. The court therefore affirmed the court of appeals’ judgment reversing the district court, although on different grounds.
