Summary

The court held that claims for compensatory relief and front pay under the Colorado Anti-Discrimination Act are not claims for injuries that lie in tort or could lie in tort, so the Colorado Governmental Immunity Act does not bar them. It further held that the term "the state" in the relevant CADA provision includes state agencies and political subdivisions. The court therefore affirmed the judgment allowing the employee's claims to proceed.
