Supreme Court of Colorado
The People of the State of Colorado, Plaintiff-Appellant v. Devon Paul Garrett Burnett, Defend — Boatright, J…
January 14, 2019432 P.3d 617
Summary
Justice Boatright dissented from the majority's determination that the trooper's interpretation of the lane-change signaling statute was objectively unreasonable and that suppression should follow. The dissent reasoned that the interpretation was arguably correct, was objectively reasonable in light of state driving guidance and comparable judicial reasoning, and, even if unreasonable, reflected no more than negligence insufficient to justify exclusion. Justice Boatright would have reversed the suppression order, and Chief Justice Coats joined the dissent.
