Supreme Court of Colorado

The People of the State of Colorado, Plaintiff-Appellant v. Shaun R. Davis, Defendant-Appellee.

April 8, 2019438 P.3d 266

Summary

The court held that officers' later use of a passcode voluntarily disclosed by the defendant did not transform a warrant-authorized cell-phone search into a consent search. Because the defendant had no legitimate expectation of privacy in passcode digits he voluntarily gave to police, officers could use the passcode to execute the otherwise valid warrant. The court therefore reversed the suppression order and remanded for further proceedings.
