Summary
The court held that police complied with the statutory requirements for advising a juvenile and the juvenile’s legal guardian before obtaining a written waiver of the guardian’s presence during questioning. It further held that, considering the totality of the circumstances, the waiver was knowing, voluntary, and intelligent despite the detective’s minimization of the alleged offenses and the lack of actual consultation between the juvenile and his guardian. The court therefore reversed the suppression order and remanded for further proceedings.
