Supreme Court of Colorado
The People of the State of Colorado v. Troy Anthony Fields, the People of the State of Colorado v. Dale Robert Reed
January 16, 2018411 P.3d 661
Summary
The court held that the officers' initial approach to the defendants' parked truck was a consensual encounter, not a seizure. By the time the officers ordered the defendants out and frisked them, they had reasonable suspicion, and subsequent admissions and firearm-related information supplied probable cause for arrest and search. The court also held that the contraband would inevitably have been discovered through the officers' independent investigation of the firearm, so it reversed both suppression orders and remanded.
