Supreme Court of Colorado
Oakwood Holdings, LLC, Petitioner v. Mortgage Investments Enterprises LLC, Respondent.
February 12, 2018410 P.3d 1249
Summary
The court held that a junior lienor who timely files a notice of intent to redeem under the applicable foreclosure statute is entitled to redeem and need not accept a payoff tendered by a certificate of purchase holder. Because the debtor-owner's statutory right to cure ended when the foreclosure sale was completed, a certificate of purchase holder acting under a post-sale power of attorney acquired no greater right to cure. The court therefore reversed the court of appeals and remanded for further proceedings.
