Supreme Court of Colorado

Charles Bewley and Berenbaum Weinshienk P.c., Petitioners v. R. Parker Semler, Respondent.

September 24, 2018432 P.3d 582

Summary

The court held that the strict privity rule barred the condominium association member’s breach-of-contract claim against the law firm, even though he alleged that he was an intended third-party beneficiary of the firm’s agreement with the association. Because the claim did not allege fraud, malicious conduct, or negligent misrepresentation, the plaintiff lacked standing to pursue it. The court therefore reversed the court of appeals and remanded for further proceedings.
