Summary
Justice Coats dissented from the majority's reversal of the defendant's convictions for attempted murder and assault. He would have held that the jury was properly permitted to hear the full statutory self-defense instruction because the evidence could support a finding that the defendant was the initial aggressor toward the police officers. He further disagreed with treating the initial-aggressor inquiry as dependent on who initiated a broader melee involving a third person. Justice Boatright joined the dissent.
