Summary

The court held that Garcia was not in custody for Miranda purposes during questioning inside or outside her home, so the absence of a Miranda advisement did not require suppression of her statements. Applying the totality-of-the-circumstances test, the court emphasized the brief, conversational questioning, familiar and public locations, lack of restraint or threats, and Garcia's indifferent responses. The court therefore reversed the suppression order.
