Justice Márquez dissented from the reversal of the trial court’s suppression order, concluding that Nguyen did not knowingly and intelligently waive his Miranda rights. She reasoned that the interpreter repeatedly mistranslated the warnings and Nguyen’s responses, failed to communicate that his statements could be used against him, inadequately conveyed the right to appointed counsel, and contributed to confusion when the advisement was considered as a whole.
