Summary

The court held that Nguyen’s translated Miranda advisement reasonably conveyed that his statements could be used against him and that an attorney would be appointed at no cost before questioning if he could not afford one. Because the waiver was voluntary and sufficiently knowing and intelligent, the court reversed the suppression order and remanded for further proceedings. Justice Márquez, joined by Justices Hood and Gabriel, dissented, concluding that the totality of the mistranslations and Nguyen’s responses showed he did not understand his rights.
