Supreme Court of Colorado
The People of the State of Colorado, Petitioner v. Emmett Andrew Lar — Hood, J., Concurring in Part and Dissenting…
April 24, 2017393 P.3d 543
Summary
Justice Hood would conclude that the trial court abused its discretion by refusing to poll jurors about a prejudicial newspaper article published during trial, because the article contained inadmissible information and the court's admonitions did not eliminate the need for polling. She nevertheless agrees that reversal is not required because the error was harmless beyond a reasonable doubt: there was no reasonable possibility that the article contributed to the conviction. Justices Márquez and Gabriel joined this concurrence in part and dissent in part.
