Summary
The court held that when the Division determines a claimant was mentally unable to perform assigned work, the unemployment statute does not permit a further inquiry into the cause of that mental condition to establish fault. Because the hearing officer found that Gomez was mentally unable to complete the required report, the court concluded that she was not at fault for her separation and was entitled to benefits. The court affirmed the court of appeals' judgment. Justice Coats, dissenting, would have permitted inquiry into whether Gomez's prior voluntary performance deficiencies caused her mental inability and separation.
