Justice Gabriel concurred in the judgment but disagreed with the majority's limitation of the juvenile-sentencing protections to literal life-without-parole sentences. He would hold that those protections extend to de facto life-without-parole sentences, while concluding that Lucero's sentence did not qualify because he would be eligible for parole at age fifty-seven. He therefore would affirm on grounds different from those adopted by the majority.
