Summary

Justice Gabriel dissented from the court's conclusion that the Innovation Schools Act permits approval of innovation plans from new schools without the specified pre-submission consents. The dissent would have required evidence that a majority of the school's teachers and school accountability committee consented before plan submission, concluding that the plans were noncompliant and could not be approved. Justice Eid, concurring in the judgment, agreed that new schools were not precluded but would have reached that result on the narrower ground that a school with no teachers had zero teachers whose consent was required.
