Supreme Court of Colorado

The People of the State of Colorado, Plaintiff-Appellant v. Amadeo Chavez-Barragan, Defendant-Appellee

September 26, 2016379 P.3d 330

Summary

The court reversed the suppression order because the detention following the lawful traffic stop was reasonable and the defendant voluntarily consented to a search of his truck. Although the defendant remained seized when he consented, that circumstance did not by itself make the consent involuntary, and the totality of the circumstances showed that police conduct did not overbear his will. Because the search was lawful, the defendant's statements were not tainted by prior illegality. No separate opinions were issued.
