Summary

Justice Gabriel dissented from the conclusion that the dependency-or-neglect jury instructions were proper. He would have held that due process and the Children's Code required the fact finder to consider and make findings about each respondent parent's acts, omissions, and circumstances before adjudicating the children dependent or neglected, and that the instructions failed to do so. Justice Hood joined the dissent.
