Summary

The court held that a privately operated prison is not a “public law enforcement agency” under section 16-10-103(1)(k), because “public” refers to an official arm or subdivision of state or federal government. The trial court therefore properly denied Bonvicini’s challenge for cause to a nurse employed by the private prison, and the court reversed the appellate court’s judgment. The court did not reach the separate question concerning the remedy for an erroneous denial of a challenge for cause.
