Mulberger v. People

Summary

The court held that a potential juror is a “compensated employee of a public law enforcement agency” only when the juror provides services to, is paid by, and is subject to the direction and control of that agency. Because the challenged nurse worked at the county jail through a private agency, was paid by that agency, and was not shown to be controlled by jail personnel, the trial court properly denied the challenge for cause. The court affirmed the court of appeals and did not decide the separate remedial question concerning an erroneous denial of a challenge for cause.
