Summary

Justice Gabriel dissents from the majority's adoption and application of a plausibility pleading standard under Colorado's civil rules. She would retain Colorado's longstanding notice-pleading approach, under which well-pleaded facts are accepted as true and a complaint need only provide fair notice of the claim and its grounds. She concludes that Hall adequately pleaded intentional interference with contract because he alleged facts supporting Warne's knowledge, intent, causation, and improper motive. Justices Marquez and Hood joined the dissent.
