Justice Coats, dissenting, would reject the conclusion that revoking probation for refusing to answer potentially incriminating questions necessarily imposes a prohibited penalty under the Fifth Amendment. He reasons that the relevant Supreme Court decisions leave the substantial-penalty question unresolved in this context and that treatment of convicted sex offenders in prison and on probation may be constitutionally comparable. Justice Eid joined the dissent.
