Supreme Court of Colorado

The People of the State of Colorado, Petitioner v. Derrick Demetrus Wilson, Respondent

June 29, 2015351 P.3d 1126

Summary

The court held that an inconsistency between a prosecutor's race-neutral explanation for a peremptory strike and the voir dire record does not, by itself, establish purposeful discrimination under Batson. At the third step of the Batson analysis, the trial court must assess the prosecutor's credibility, and appellate review is deferential, reversing only for clear error. Because the trial court reasonably credited the prosecutor's explanation, the court reversed the court of appeals and remanded for further proceedings.
