Supreme Court of Colorado

Oasis Legal Finance Group, LLC; Oasis Legal Finance, LLC; Oasis Legal Finance Operating Company, LLC; and Plaintiff…

November 16, 20152015 Colo. LEXIS 1075

Summary

The court held that litigation-finance agreements under which companies advance money to personal-injury plaintiffs in exchange for future litigation proceeds are loans subject to Colorado's Uniform Consumer Credit Code. The transactions create an obligation to repay that generally increases over time, and the absence of personal liability for any deficiency does not prevent the agreements from creating debt or qualifying as loans. The court therefore affirmed the court of appeals' judgment.
