Supreme Court of Colorado
Joyce Reno v. Marilyn Marks, Respondent
May 26, 2015349 P.3d 248
Summary
The court held that CORA's attorney-fee provision applies when an official custodian initiates an action seeking to prohibit or restrict disclosure of requested records. A prevailing records requestor is ordinarily entitled to costs and reasonable attorney fees unless the custodian properly denied inspection. Because the district court found that the Clerk's denial was proper under the circumstances existing when she filed the action, the requestor was not entitled to fees, and the court reversed the court of appeals.
