Summary

The court held that a defendant convicted of a sex offense that is also a crime of violence must receive an indeterminate prison sentence with a minimum term within the enhanced crime-of-violence range. Because Chavez's offense was a per se crime of violence, he was ineligible for probation and his fifteen-years-to-life sentence was legal. The court therefore affirmed the court of appeals.
