Supreme Court of Colorado
Anthony James Chavez, Petitioner v. the People of the State of Colorado, Respondent
November 2, 2015359 P.3d 1040
Summary
The court held that a defendant convicted of a sex offense that is also a crime of violence must receive an indeterminate prison sentence with a minimum term within the enhanced crime-of-violence range. Because Chavez's class-three felony required a minimum term between eight and twenty-four years, his fifteen-year-to-life sentence was lawful and probation was unavailable. The court therefore affirmed the court of appeals.
