Summary

The court held that the criminal discovery rule does not require disclosure of information obtained by the prosecution while preparing to respond to post-conviction claims. It nevertheless held that due process and the court's death-penalty review procedure require disclosure of favorable evidence, including some possibly exculpatory evidence that may not satisfy the ordinary materiality standard. The matters were remanded for application of that disclosure standard and procedure.
