Summary

The court held that the trial court abused its discretion by requiring retained attorneys to represent DeAtley after finding that a conflict of interest existed and after DeAtley had discharged them and sued them. The proper remedy was to permit counsel to withdraw, advise DeAtley of his options under the criminal procedure rule, and give an advisement concerning the consequences of further delay and proceeding without counsel. The court reversed the order denying withdrawal, made its rule absolute, and remanded for further proceedings.
