Supreme Court of Colorado

The People of the State of Colorado v. Kim Maurice Fuerst — Hobbs, J., Concurring

May 20, 2013302 P.3d 253

Summary

Justice Hobbs concurred only in the judgment on the ground that the officers' warrantless entry was reasonable because Fuerst was barred by a protection order from entering or remaining at the residence and therefore lacked common authority over it. The concurrence concluded that Fuerst could not negate his wife's consent, even assuming that he expressly objected to the entry. Justices Coats and Eid joined the concurrence.
