Summary

The court held that Black Hawk's ordinance banning bicycles from virtually all city streets, including the only route connecting Central City to the Peak-to-Peak Highway, involved a mixed state and local concern. Because the ordinance prohibited bicycling without providing the suitable alternative route required by state law, it conflicted with and was preempted by that law. The court reversed the district court and remanded for further proceedings consistent with its opinion.
