Supreme Court of Colorado
M.t. v. People — Marquez, J., Dissenting
February 13, 2012269 P.3d 1219
Summary
Justice Marquez dissented from the majority's interpretation of the record-sealing statute, concluding that the statutory term "conviction" does not include a successfully completed deferred judgment when the legislature had removed an express reference to deferred judgments. She would have left any expansion of the sealing exception to the legislature rather than importing an absent cross-reference or adding words to the statute. Justice Hobbs, concurring, would affirm on the ground that the statutory history shows successfully completed deferred judgments in sexual-offense cases were intended to remain unsealable.
